Diligent Inquiry of the Seller

At the listing appointment, always make a diligent inquiry of the Seller regarding:

  1. Insurance Claims in the last 5 years. [This question is on SPQ, but make sure, if there are any claims, that you have Seller give detailed explanations.]
  2. Deaths on the Property in the last 3 years. [This question is on SPQ, but make sure, if “Yes,” that you have Seller give detailed explanation.]
  3. Any Liens against the Property.
  4. Any Leases that may need to be assumed by potential Buyer.
  5. Any Warranties that may be able to transfer to a potential Buyer.
  6. Any Prior inspections in Seller’s possession.
  7. Any Upgrades to the Property. If so, have Seller give you copies of all related contractor documentation, invoices and Building Permits as applicable.
    1. Seller to disclose any inspections for exterior wood balconies, stairs or other elevated elements. Need WBSA. Condos subject to SB721. TDS C.4. & C.5. and related note / SPQ 6.K. and 7.E & 7.F.
    2. Seller to disclose any room additions, structural modifications, other alterations or repairs within last 18 months. TDS C.4. & C.5. and related note / SPQ 6.K. and 7.E & 7.F.
  8. Any other Material facts that a potential Buyer may need to take into consideration when buying the Property.
