Diligent Inquiry of the Seller
At the listing appointment, always make a diligent inquiry of the Seller regarding:
- Insurance Claims in the last 5 years. [This question is on SPQ, but make sure, if there are any claims, that you have Seller give detailed explanations.]
- Deaths on the Property in the last 3 years. [This question is on SPQ, but make sure, if “Yes,” that you have Seller give detailed explanation.]
- Any Liens against the Property.
- Any Leases that may need to be assumed by potential Buyer.
- Any Warranties that may be able to transfer to a potential Buyer.
- Any Prior inspections in Seller’s possession.
- Any Upgrades to the Property. If so, have Seller give you copies of all related contractor documentation, invoices and Building Permits as applicable.
- Seller to disclose any inspections for exterior wood balconies, stairs or other elevated elements. Need WBSA. Condos subject to SB721. TDS C.4. & C.5. and related note / SPQ 6.K. and 7.E & 7.F.
- Seller to disclose any room additions, structural modifications, other alterations or repairs within last 18 months. TDS C.4. & C.5. and related note / SPQ 6.K. and 7.E & 7.F.
- Any other Material facts that a potential Buyer may need to take into consideration when buying the Property.
