Buyer’s Agent to Use the BIE & BIW

Buyer’s Agent is responsible to use the BIE [Buyer Investigation Elections] and BIW [Buyer Investigation Waiver] with any Buyer-side transaction.

BIE [Buyer Investigation Elections]

Discuss with Buyer(s) which inspections they choose to have done. Have them check the appropriate boxes for the inspections they are choosing and/or not choosing to do. This is to be done before inspections are ordered.

If they choose to do no inspections at all, they should complete the BIE noting “no inspections” and the BIW and initial the appropriate paragraphs. If applicable, you may put: “Seller has provided the following inspections: _____________”

BIW [Buyer Investigation Waiver] – When you are going inspections with your Buyer(s), inspectors or you may recommend further inspections [i.e. roof, chimney, soils, etc.].

Paragraph 3.A. Buyer should initial if Buyer did not obtain a Home Inspection.

Paragraph 3.B. Buyer should initial if Buyer did not obtain a Pest Inspection

Paragraph 3.C. If Buyer’s Agent recommends any inspections, Buyer should initial if Buyer decides not to get any recommended inspection(s).

Paragraph 4. Buyer’s Agent should list all inspections that Buyer has received, Buyer should initial if Buyer decides not to obtain any additional inspections.

BIE and BIW is only to be used with Keller Williams Buyers.

CAR Legal has stated at the top of each form that the BIE and BIW are only for the internal use of the Buyer’s Broker.

Buyer’s Broker has no obligation to provide the BIE and BIW to the Listing Broker. If Keller Williams is the Listing Broker, cooperating Broker has no obligation to provide the BIE or BIW.
