FHDS & WDFA requirement
FHDS [Fire Hardening and Defensible Space Disclosure and Addendum] is a Statutory disclosure, but only required if Property is in a STATE or LOCAL high or very high fire severity zone.
WFDA [Wildfire Disaster Advisory] is required on all transactions.
LISTING – Seller has the obligation to determine if compliance with the fire hardening and defensible space requirements are applicable to the Seller and the Property. When entering into a listing agreement, Seller needs to order a NHD Report and review the NHDS and following summary page(s) to help make this determination.
- FHDS – Seller is to provide the FHDS if Property is in a STATE or LOCAL high or very high fire severity zone.
- Check FHDS paragraph 2.B boxes 1-6 and paragraph 3.A. for is or is NOT subject to local vegetation ordinance [fire zone]. If homeowner does not know [Condo], then check “No” for all boxes in paragraph 2 and then check appropriate box in 3.A.
- Always check City & County requirements – May need fire department inspection.
- WFDA – WFDA should always be provided to Buyer.
