FHDS & WFDA requirement
LISTING – Seller has the obligation to determine if compliance with the fire hardening and defensible space requirements is applicable to the Seller and the Property. NHD (Natural Hazard Disclosure) Report
NHD – Natural Hazard Disclosure Report is a Statutory Disclosure on all transactions. When entering into a listing agreement, Seller needs to order a NHD (Natural Hazard Disclosure) Report and review the NHDS page and following summary page(s) to help make this determination of compliance. Seller should contact local City or County Offices to help in this determination. If Seller does not do this, then Listing Agent should.
FHDS – Fire Hardening and Defensible Space Disclosure and Addendum is a Statutory disclosure, but only required if Property is in a STATE or LOCAL high or very high fire severity zone on the NHDS page of the NHD Report.
FHDS – Seller is to provide the FHDS if Property is in a STATE or LOCAL high or very high fire severity zone. FHD provides valuable information to Buyer. Seller to complete paragraph 2.B and 3.A.
- Paragraph 2.B boxes 1-6 – If homeowner does not know [Condo], then check “No” for all boxes in paragraph 2 as the questions are presented as: “Are you aware of.”
- Paragraph 3.A. – Check box for “IS” or “IS NOT” subject to local vegetation ordinance [fire zone].
- Always check City & County requirements – May require fire department inspection.
- WFDA – WFDA should always be provided to Buyer.
WFDA – Wildfire Disaster Advisory Disclosure and Addendum is required on all transactions. (If Seller doesn’t provide the WFDA, Buyer’s Agent to provide one).
- Paragraph 5 – Explains Fire Hardening & Defensible Space Law and gives information for Buyer.
- Paragraph 6 – Agents/Brokers have no authority or expertise for guidance. Buyer/Lessee has an affirmative duty to exercise reasonable care in protecting themselves.
