Social Media: MUST READ-COMPLIANCE Posted by your broker

Please fix your social media and web pages to be aligned with DRE rules and regs.  I am finding lots and lots of people out of compliance…many with other companies.  Let’s make sure it’s not us

 LinkedIn: Some of your “owner” as your company. And no affiliation included.

 Facebook pages: Many pages look like they are independent companies-especially those in groups and teams…no prominent, in compliant with DRE affiliation, as noted below.

How about business directed Pinterest, Google, Blogs, and YouTube channels?  PLEASE GO FIX.

WARNING: DIRECTLY FROM DRE:

LICENSING ALERT……….Also, it is evident that a number of salespersons have branded themselves as independent real estate practitioners, and they practice and advertise as such. That is unlawful as well, and the advertisements in connection therewith are false and misleading to the public. Furthermore, and depending on the language used with respect to the “branding”, there might be a violation of the law relative to the use of fictitious names. Please see the prior guidance given by Cal DRE on the use of fictitious names.

This communication is written as a warning to those real estate salespersons, and all other salespersons, who provide real estate services – for which a license is required — without being affiliated with and supervised by a broker.

AND…FROM OUR ATTORNEYS:

Advertising that contains a team name “including print or electronic media and ‘for sale’ signs”, nevertheless must adhere to the following:

  • Advertising shall include the licensee’s name and license number in all advertising, and shall be displayed in a conspicuous manner.
  • “The responsible broker’s identity shall be displayed as prominently and conspicuously as the team name in all advertising.”
  • The advertising material shall not contain terms that imply the existence of a real estate entity independent of the responsible broker.

This doesn’t just apply to TEAMS . . . All Agents must comply . . . just just happened to be the forum that was being discussed.

Please take a minute to check out how you are representing, and fix as needed ASAP!
