Requests for Repairs
Negotiate repairs between Seller & Buyer.
RR #1 – Request for Repair. Buyer may request Seller make repairs.
1. Seller agrees to all of Buyer’s Requests. RR #1 then is complete. Buyer does not need to sign RR #1 again.
2. Seller may check box for “partial agreement.”
- Buyer may accept Seller’s “partial” agreement and signs Buyer’s section. RR #1 then is complete.
- Buyer may not accept Seller’s response and may offer a RR #2.
3. Seller responds on attached RRRR #1. MOST COMMON RESPONSE
- Buyer may accept or may not accept Seller’s response and may offer a RR #2.
4. Seller may check box for “Seller does NOT agree to any of Buyer’s requests.” RR #1 then is complete.
RRRR #1 – Response & Reply to RR. Seller responds to Buyer request or may offer credit toward Buyer’s Closing Cost. Buyer completes the Buyer Reply to Seller response section.
1.Buyer accepts Seller’s response and signs at bottom of section.
2.Buyer accepts with some modifications, which Seller would then respond at bottom of the form.
3.If Seller response is not acceptable, Buyer checks box 3 to withdraw original request and issue a new RR #2. Any credit for Buyer’s Closing Costs is to be confirmed by an addendum which is disclosed to the Lender.
Buyer should always use the RR [Request for Repairs] and Seller use the RRRR [Seller Response and Buyer Reply to Request for Repairs] when negotiating any repairs to be completed by Seller.
Remember that the RR & RRRR are not given to the Lender. In that regard, these forms are kind of like “worksheets” for negotiation purposes only.
Never “tie” the RR to the CR [Contingency Removal] stating: “Buyer removes all contingencies subject to the Seller agreeing to Request for Repairs.” This is unenforceable and is not to be done.
RR/RRRR process is to be completed with all negotiations need to be agreed to by all parties before a CR [Contingency Removal] is executed.
